Effective June 10, 2026, businesses in New York State that are required to maintain a workplace first aid kit must include an opioid antagonist (such as naloxone/Narcan®) in that first aid kit. This applies to virtually all restaurants, bars, nightclubs, and other hospitality-focused businesses in New York.
What is an opioid antagonist?
An opioid antagonist is a medication that can rapidly reverse the effects of an opioid overdose. Naloxone works by restoring breathing in a person whose breathing has slowed or stopped due to opioids.
What your business must do to comply with the new law:
- Confirm your business maintains an OSHA-required first aid kit.
- Add an opioid antagonist (e.g., naloxone nasal spray) to the kit.
- Store it according to manufacturer instructions.
- Monitor expiration dates and replace as needed.
- Ensure managers know where it is located and how it is used.
Employees who administer naloxone in good faith during an emergency are generally protected under New York’s Good Samaritan laws. We recommended you consult with counsel should you have questions.
