Here’s the reality:
NYC does not have the legal authority to do this. Legal analysis from the NYC Hospitality Alliance and leading scholars shows the proposal conflicts with state law and decades of precedent – making it unlawful on its face.
These City Council members are ignoring this and continuing to push the bill. Taking a page from the Trump/Miller playbook, they want to pass a law that is illegal just to test it in the courts in the hope they get a favorable ruling.
